Which party to a taxable transaction is liable for payment of documentary stamp tax?

Any party to a taxable document, such as transferor or transferee for deeds, lender or borrower for written obligations to pay money, or mortgagor or mortgagee for mortgages, is liable for the tax unless the party itself is exempt. The following are subject to documentary stamp tax:

  • Documents that transfer an interest in Florida real property, such as a deed;
  • Written obligations to pay money that are signed or delivered in Florida, such as a car loan; and
  • Mortgages that secure the obligations, when recorded.

A party involved in five or more taxable transactions in any given month where the tax is being paid directly to the Department of Revenue must register with the Department​.
